Sales Terms and Conditions

This Printing Services Agreement (the “Agreement”) is between you and Need Marketing Group (“NMG”). Your use of the Services signifies your agreement to the terms and conditions of use set forth in this Agreement, as it may be amended from time to time. Please read this Agreement carefully as it forms a binding contract between you and “NMG”.

Orders, Payments and Refunds

All orders must be prepaid due to the speed of our turnaround. Under NO conditions does NMG print on terms or extend credit. Since each job is custom created for its owner, it can not be reused or resold. After production has commenced, ALL SALES ARE FINAL.

All payments are made to Need Marketing Group.

Forms of Payment

Personal/Business Checks
All checks will be subject to a 3-10 day hold before any work begins. Returned checks are subject to a $25.00 bank fee. A copy of current State Driver's License or I.D. is necessary to pay via check.

Credit Cards
Visa, Mastercard, American Express and Discover
For a successful credit card transaction we need:

1. Cardholder’s name as shown on card
2. Address where card’s billing statement is sent.
3. Credit Card number
4. Expiration Date
5. CVC number (3-digit number on back of your card or 4-digit on American Express)

Orders, Cancellations and Chargebacks

Acceptance of orders is subject to credit approval and contingencies like fire, water, strikes, theft, vandalism, acts of God, and other causes beyond and other causes beyond causes of the provider. Cancellations require compensation for incurred costs and obligations. A cancellation fee of at least $50.00 will be deducted from deposit amount.

If you receive the merchandise you have ordered you agree not to perform a chargeback as long as we adhere to the terms set forth in this document.

Graphic Design & Approval Process

To begin your graphic design project we need:

1. Information for back and front separated per side
2. Photograph’s you’d like used per side
3. Company logo if necessary
4. Any other pertinent information

Creative Work

Sketches, copy and all other creative work developed or furnished by our firm is our exclusive property. We must provide you with written approval for all use of this work and for many derivation of ideas from it.

Alterations and Corrections

Customer alterations include all work performed in addition to the original specifications. All such work will be charged at our current rates.

Approval

When viewing the proofs make sure: all information is included and everything is spelled correctly. We will not take responsibility for any jobs that are printed with misspelled or excluded information.

Turnaround Time

Initial design turnaround time will be disclosed at time of order approval. Turnaround time only applies to initial design. Alterations and corrections will make delivery dates subject to renegotiation.

Printing

Production Schedules
Production schedules will be established and followed by the customer and NMG and it’s subsidiaries. In the event that the schedule is not adhered to by the customer, delivery dates will be subject to renegotiation. There will be no penalty or liability for delays due to state of war, riot, civil disorder, fire, strikes, accidents, action of government or civil authority, acts of God and other causes beyond the control of NNMG and NeedPostcards.com. In such cases, schedules will be extended by an amount of time equal to the delay incurred. NMG will work to the best of it’s ability to ensure that your job arrives in the alloted time. NMG does not accept responsibility for third party delays such as shipping companies, Acts of God such as inclement weather, fires, mechanical breakdowns and other conditions outside of our control, however, such delays are rare.

Color Matching

NMG and its subsidiaries print gang run jobs for any job smaller than 8.5x11. NMG will reproduce color digital layouts as closely as possible but cannot exactly match color and density because of limitations in the printing process, as well as neighboring image ink requirements. The accuracy of each color reproduction is guaranteed to be within 85%-100% of the original image you submitted. we accept no responsibility for color variations between submitted images and the actual artwork or product they represent.

Color Critical jobs must be submitted clearly noted as Color Critical, and must be accompanied by a request for Color Proof. Color Proofs are not included in our base cost schedule and will incur an additional charge. Printing prices for a dedicated press run will also vary from those advertised on this web site. Please take special care to clearly indicate a job as Color Critical so that special attention can be given to that job. We will not be liable for color variations which are common when printing gang runs unless a job is clearly identified as Color Critical at the time of order.

Third Party Artwork Submission

You are 100% responsible for the accuracy of your layout. We do not check for image quality or color, spelling or grammatical errors or other errors. Please proofread your artwork carefully before submission. Postal Regulations are subject to constant change, you are also 100% responsible for complying with current mailing restrictions for postcard backside layouts. Please check with your local post office.

Tag Line

All pieces printed by us will have a 6pt. tag reading: "Printing by needpostcards.com" placed close to the edge of piece unless otherwise agreed upon. A "No Tag" fee of $20.00 will be accessed per 5,000 increments in orders.

Overruns/Underruns

Over and Under Runs will not exceed 10% of the quantity ordered. If a guaranteed amount is required the percentage of tolerance should be stated at time of order and will be billed accordingly.

Cutting

Critical type or images must be at least 1/4" from the edge of the card. We are not responsible for type, art or images that are cut off if these guidelines are not followed. Furthermore, it is strongly suggested that you do not use a thin border around your postcard. This may cause an uneven frame around your card. If you desire to have a border, it should be at least 1/4" thick.

You must adhere to the layout specifications, please use the appropriate templates supplied on our website to ensure accuracy. Files that do not follow the instructions provided will delay your job and will incur extra charges. If you employ the services of a third party designer make sure that all file submission specifications are understood and followed.

Cancellations

All cancellations must be made by 2:30PM on the date of order. We will try to stop the job to the best of our ability; however, we require compensation for incurred costs and obligations. A cancellation fee of at least $50.00 will be deducted from deposit amount or 100% percent of fee for completed portion of work.

Consent to Jurisdiction and Venue

This Agreement is executed in the State of Florida and it is to be construed under and in accordance with the laws of the State of Florida. In addition, both you and “NMG” consent to jurisdiction of the County or Circuit or Federal Courts located in Miami-Dade County, Florida.
